The federal minimum wage remains $7.25 per hour — unchanged since July 2009. Employers covered by the Fair Labor Standards Act (FLSA) must pay at least this rate. However, 42 states have set their own higher minimum wages. The highest state minimum wage in 2026 is DC at $18.40/hr.
What states have no minimum wage law?
Five states have no state minimum wage law: Alabama, Louisiana, Mississippi, South Carolina, and Tennessee. The federal $7.25 rate applies to all FLSA-covered employers in those states.
How does overtime work?
Federal law (FLSA) requires overtime pay at 1.5x the regular rate for all non-exempt employees who work more than 40 hours in a workweek. Four states — California, Alaska, Nevada, and Colorado — also have daily overtime rules: in California, any hours over 8 in a single day trigger 1.5x pay, and over 12 hours triggers 2x pay, regardless of weekly total.
What is tipped minimum wage?
Tipped minimum wage is the reduced cash wage employers can pay to employees who regularly receive tips, as long as tips bring total hourly earnings up to the standard minimum wage. The federal tipped minimum is $2.13/hr. However, 8 states have eliminated the tip credit entirely: Alaska, California, Minnesota, Montana, Nevada, Oregon, Washington, and DC — tipped employees in those states must receive the full minimum wage regardless of tips.
