Frequently Asked Questions
How do I calculate overtime pay for California?
California requires overtime pay (1.5x your regular rate) for any hours worked over 8 in a single day, OR over 40 in a single week. Additionally, California requires double time (2.0x) for any hours worked over 12 in a single day, and for all hours worked over 8 on the 7th consecutive day of work in a workweek.
How is overtime calculated in California?
California uses both daily AND weekly overtime — 1.5x after 8 hours/day or 40 hours/week, 2x after 12 hours/day. Your employer must pay whichever calculation results in more pay.
What is the 2026 federal overtime salary threshold?
The federal threshold is $684/week ($35,568/year). Employees earning below this threshold who perform executive, administrative, or professional duties are entitled to overtime. Note: A 2024 rule attempting to raise this to $1,128/week was vacated by a federal court in November 2024 and does not apply.
Am I exempt from overtime if I'm on salary?
Not automatically. To be exempt, you must: (1) earn above your state's salary threshold, AND (2) primarily perform executive, administrative, or professional duties. Many salaried employees still qualify for overtime.
Does overtime apply to independent contractors?
No. Federal overtime law (FLSA) only covers employees, not independent contractors. However, if you are misclassified as a contractor when you actually function as an employee, you may be owed overtime. You can file a complaint with the US Department of Labor Wage and Hour Division.
